Welcome to Stack Gardens ("we", "us", or "our"). These Terms of Service ("Terms") govern your use of our website located at www.stackgardens.com (the "Site") and any related services, products, features, or content we provide (collectively, the “Services”). By accessing or using the Site, purchasing our products, or engaging with our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site or Services.

1. Eligibility – You must be at least 18 years old or the age of majority in your jurisdiction to use this Site. By using the Services, you represent and warrant that you meet these requirements.

2. Products and Health Disclaimer – Our hydroponic products are designed for personal, non-commercial indoor growing purposes. While we strive to provide safe and effective products, we do not make any guarantees regarding plant growth, yield, health benefits, or system performance under customer-specific conditions. You acknowledge and agree: results may vary based on plant type, climate, water quality, nutrient use, lighting, and user practices. Our products are not intended for medicinal use or to diagnose, treat, cure, or prevent any disease. You use our products at your own risk. Stack Gardens is not liable for any injuries, damages, or losses related to improper setup, misuse, environmental factors, or modifications to the system. Always follow the instructions provided.

3. Orders, Payments & Pricing – All orders are subject to acceptance and availability. Prices are listed in CAD or USD, and we reserve the right to change pricing at any time without notice. You agree that: you are authorized to use the payment method provided; we may cancel or refuse any order at our discretion (e.g. fraud suspicion, pricing error, etc.); in the event of a pricing or product listing error, we reserve the right to cancel or adjust the order accordingly.

4. Shipping & Returns – Please refer to our Shipping Policy and Returns & Refunds Policy for details. By purchasing, you acknowledge that you have read and agree to those policies. We are not responsible for delays caused by carriers, weather, customs, or force majeure events. Any delivery timelines provided are estimates and not guaranteed. Returned products must meet all requirements outlined in our Return Policy to be eligible for a refund. We reserve the right to deny returns that do not meet our conditions.

5. Intellectual Property – All content on the Site, including but not limited to text, images, graphics, videos, logos, product designs, and code, is owned by or licensed to Stack Gardens and protected by intellectual property laws. You agree not to: copy, modify, reproduce, republish, transmit, or distribute any part of the Site or its content without written permission; use our trademarks, trade dress, or copyrighted materials without authorization.

6. User Conduct – You agree not to: violate any laws or regulations while using our Services; attempt to gain unauthorized access to our systems or interfere with the security or operation of the Site; use the Site for fraudulent or misleading purposes; post any content that is unlawful, harmful, defamatory, obscene, harassing, or infringes on others' rights.

7. Disclaimers – THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE: that the Site will be secure or available at any particular time or location; that any defects or errors will be corrected; that results from using our products will meet your expectations.

Limitation of Liability – To the fullest extent permitted by law, Stack Gardens, its owners, officers, employees, and affiliates are not liable for any: indirect, incidental, punitive, special, or consequential damages; personal injury, property damage, loss of profits, data, goodwill, or business interruption; damages arising out of the use or inability to use our products, Services, or the Site, even if we were advised of the possibility of such damages. Your sole and exclusive remedy for dissatisfaction with the Site or Services is to stop using them.

Indemnification – You agree to indemnify, defend, and hold harmless Stack Gardens, its owners, employees, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected to: your use or misuse of the Services or products; your violation of these Terms or any applicable law; your infringement of any third party’s rights.

10. Third-Party Links & Services – Our Site may contain links to third-party websites or tools (like Shopify, payment processors, etc.). We are not responsible for their content, policies, or practices, and you use them at your own risk.

11. Termination – We reserve the right to suspend or terminate your access to the Site and Services at any time, for any reason, including if we believe you have violated these Terms.

12. Governing Law – These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes must be resolved in the courts located in Ontario, unless otherwise required by law.

13. Severability – If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
